Our nationally recognized Bankruptcy and Insolvency practice has been at the forefront of the country’s largest and most complex reorganization cases for almost 30 years. We take great pride in, and receive industry and client accolades, for our responsiveness, substantive knowledge of bankruptcy law, and familiarity with the Delaware Bankruptcy Court and local practice.
Supported by the firm’s corporate and commercial counseling and litigation groups, our practice is broad and diverse, representing virtually all constituencies in chapter 11 and 7 cases. Whether it be for debtors, creditors’ committees, equity committees, trustees, lenders, agents, bondholders, trade creditors, landlords, or other key parties in interest, we employ our solid negotiation and litigation skills in an effort to efficiently achieve the desired business objectives of our clients.

Our Commercial Litigation and Counseling group is nationally recognized as one of the most knowledgeable and responsive Delaware practices, with a proven track record in Delaware’s Court of Chancery. We represent corporate, bank, and insurance clients in a range of matters before each of Delaware’s state courts and the United States District Court for the District of Delaware.
Our group regularly advises clients with regard to issues of Delaware law involving a wide variety of complex commercial transactions, including investment agreements, asset purchase agreements, license agreements, and supply contracts. In connection with transactional matters, we also render formal legal opinions regarding the application of Delaware law to particular components of a commercial transaction.

Our Corporate Litigation and Counseling practice serves clients involved in litigation and facing corporate governance questions, often working collaboratively with in-house counsel and other law firms. Our practice both defending and prosecuting actions in the Court of Chancery, as both lead and Delaware counsel, brings a range of experiences and perspectives that we employ in working efficiently to achieve positive outcomes for our clients, which range from Fortune 500 companies to individuals. Our areas of particular strength include litigation relating to, among other things, mergers and acquisitions, fiduciary duties, and proxy contests.
Our many years of experience litigating in the Court of Chancery and regularly serving on the Corporation Law Council gives us the knowledge and expertise to serve as advisors on various matters of Delaware corporate and alternative entity law. Our members actively counsel sophisticated clients on business structure questions, including issues related to the negotiation and consummation of mergers, asset sales, stockholder distributions, and other fundamental corporate transactions. We also frequently advise special committees of boards of directors dealing with conflict transactions or stockholder litigation demands on questions of director and officer responsibilities and fiduciary duties.

The United States District Court in Delaware is the premier venue for much of this country’s major patent and other intellectual property litigation, and Ashby & Geddes is recognized as one of the ‘go-to’ law firms in this complex field. Members of our IP Litigation group are particularly experienced in serving as Delaware counsel to large corporations, and they regularly advise clients and co-counsel on a wide array of intellectual property matters across diverse markets including the pharmaceutical and biotechnology industries, telecommunications sector, computer hardware and software industries, and more. Our firm’s IP lawyers are well known to the District Court and have served on its Lawyer Advisory Committee and a committee tasked with creating uniform jury instructions for use in patent litigation, as well as the executive board of the Delaware Chapter of the Federal Bar Association.

Ashby & Geddes has extensive experience representing plaintiffs in complex medical negligence and personal injury cases, as well as cases involving motor vehicle accidents, premises liability claims, and construction site matters. Although cases may sometimes be settled prior to trial, the group regularly tries such matters achieving favorable verdicts in Delaware’s courts.

Robbins, one of the firm’s Directors and recognized by his peers as one of the top medical negligence attorneys in Delaware. The practice won one of the largest medical malpractice verdicts in Delaware history.
